Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the driving instruction services provided by Best and Less Driving School ("we", "us", or "our"), operating from Blacktown, Sydney NSW. By booking a lesson or purchasing a package, you agree to be bound by these Terms. Please read them carefully before proceeding with any booking.

1. Booking and Scheduling

Lessons can be booked by phone, email, or through our website. When you make a booking, you are entering into an agreement with us to provide driving instruction at the agreed date, time, and location. We will make every reasonable effort to accommodate your preferred schedule, but availability is subject to instructor and vehicle capacity. Confirmation of your booking will be provided via phone call, SMS, or email. It is your responsibility to ensure the booking details are correct and to notify us promptly of any errors.

2. Payment Terms

Payment for individual lessons is due at the time of booking or, at the latest, before the lesson commences. Lesson packages must be paid in full at the time of purchase unless a payment plan has been specifically arranged and confirmed in writing. We accept payment by cash, bank transfer, and major credit and debit cards. All prices are quoted in Australian dollars and include GST where applicable. We reserve the right to adjust our pricing at any time, though any changes will not affect lessons or packages already paid for.

3. Cancellation Policy

We understand that plans can change. If you need to cancel or reschedule a lesson, we ask that you provide us with at least 24 hours' notice. Cancellations made with less than 24 hours' notice will incur a fee of $20 to cover the cost of the reserved time slot. If you fail to attend a scheduled lesson without any prior notice (a "no-show"), the full lesson fee will be charged. Repeated no-shows may result in a requirement to pre-pay for all future bookings. We may cancel or reschedule lessons due to severe weather, vehicle breakdown, or other circumstances beyond our control, and in such cases no cancellation fee will apply—we will offer you an alternative time or a full credit.

4. Student Requirements

To participate in a driving lesson, you must hold a valid NSW Learner Permit or the appropriate licence for the type of instruction you are receiving. You are required to bring your learner permit or licence to every lesson—if you arrive without valid identification, the lesson cannot proceed and the full fee will apply. You must be in a fit state to drive, which means you must not be under the influence of alcohol, drugs, or any medication that may impair your ability to operate a vehicle safely. If your instructor reasonably believes you are unfit to drive, the lesson will be terminated and the full fee will be charged.

5. Lesson Conduct

During lessons, you must follow the instructions of your driving instructor at all times. Our instructors have dual controls and will intervene when necessary to maintain safety. Abusive, threatening, or disrespectful behaviour toward your instructor will not be tolerated, and the lesson will be ended immediately with no refund. We expect students to arrive on time for their scheduled lesson. If you are more than 15 minutes late without prior notice, the instructor may treat the lesson as a no-show.

6. Our Vehicle

We provide a fully insured, well-maintained, dual-control vehicle for all lessons. You must treat the vehicle with care and report any damage immediately. You are not permitted to smoke, vape, eat, or consume beverages other than water inside the vehicle. In the event that you cause wilful damage to the vehicle, you may be held liable for repair costs.

7. Liability and Insurance

Our vehicle is covered by comprehensive insurance and compulsory third-party insurance as required by NSW law. However, our instruction does not guarantee that you will pass the driving test—outcomes depend on your individual skill, preparation, and performance on the day. We are not liable for any loss, injury, or damage arising from circumstances outside our reasonable control. To the maximum extent permitted by Australian Consumer Law, our total liability for any claim connected to our services is limited to the amount you paid for the specific lesson or package in question.

8. Driving Test Bookings

If you book our vehicle for use during a Transport for NSW driving test, you must confirm the test date and time with us at least 48 hours in advance. Cancellation of a test-day booking with less than 48 hours' notice will be charged at the full test-day vehicle hire rate, as we reserve the vehicle and instructor exclusively for your test slot. We are not responsible for the outcome of any driving test, nor for any fees charged by Transport for NSW.

9. Intellectual Property

All content on our website—including text, images, graphics, logos, and course materials—is the property of Best and Less Driving School or its licensors and is protected by Australian copyright law. You may not reproduce, distribute, or use any of our content for commercial purposes without our prior written consent. Any training materials or handouts provided during your lessons are for your personal use only and may not be copied or redistributed.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales. Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law that cannot be excluded by agreement.

11. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of our services after changes are published constitutes your acceptance of the revised Terms.
